Supreme Court: online threats must be intentional to be illegal

You can’t be sent to prison for kinda sorta threats in the real world, and that now applies to the internet as well. The US Supreme Court has overturned the conviction in Anthony Elonis v. United States on the grounds that online threats aren’t illegal unless they’re clearly intentional — not just that a “reasonable person” would see them as hostile. When Elonis raged against his ex-wife and the government through allegedly “therapeutic” rap lyrics on Facebook, the court says, it wasn’t absolutely certain that he actually wished harm. The man isn’t out of the woods yet (a lower court has to look at the case once again), but there’s now a higher standard for putting him behind bars.

Whether or not this is a smart decision depends on who you ask. The American Civil Liberties Union is a big fan of the ruling, since it acknowledges “centuries” of legal precedent that requires the government to prove there was criminal intent. At the least, it reduces the chances that you’ll be hauled off simply for writing a mean-spirited social network update or blog post.

However, both dissenting judges and women’s groups are more than a little nervous. The court didn’t set a clear standard for what constitutes intent, potentially creating a lot of ambiguity at trials. Would it be enough to know you were being reckless to be found guilty, for instance? Likewise, there’s a concern that this interpretation will let internet abusers skirt around the law by writing hate-filled posts that aren’t technically threats, but are still likely to scare their targets. The sites hosting this content can always ban the offenders and delete their material, but it may be tougher to convict someone whose digital attacks really are a precursor to physical violence.

Of course there’s a shark in this ‘Call of Duty’ Exo Zombies video


Carrier, the latest map for Call of Duty: Advanced Warfare‘s Exo Zombies mode, is a seafaring vessel infested with hordes of ravenous former-humans. Since it’s on the open seas, of course the ship has a tank with a monstrous, toothy shark just chillin’ inside. The shark isn’t the intended star of this trailer — Bruce Campbell and the zombie-slaughtering gunplay is — but anything with that many teeth is sure to steal the show. See for yourself below. Exo Zombies Carrier is part of the Supremacy DLC pack, due to hit Xbox Live on June 2, with additional platforms to follow.

AirDog’s auto-following camera drone launches on August 31st

It’s been several months since AirDog’s namesake tag-along camera drone was originally expected to ship, but the award-winning robotic flyer is finally close to reaching your doorstep. The company has confirmed that its sports-oriented companion will officially launch on August 31st for $1,295, with crowdfunding backers getting the first batch. There are still some tweaks left (AirDog wants to improve the connection to the wearable “leash” that makes following work, for one thing), but it should otherwise be good to go. You will have to wait a bit longer if you want to check out the competition, though. The rival Hexo+ drone doesn’t ship until the fall, so you might want to postpone making that epic biking movie if you’re not sure which unmanned vehicle will deliver the best footage.

Apple Won’t Debut Subscription Television Service at WWDC


Apple does not plan to announce its streaming television subscription service at the Worldwide Developers Conference next week, reports Re/code, citing sources with knowledge of Apple’s plans. Apple has informed television network executives that launch will be postponed because the company has not yet signed the necessary deals.

Apple wanted to launch a subscription TV service in early fall to coincide with the start of the new broadcast television season. But the debut got bogged down by negotiations over financial terms and new technology that would be required for broadcasters to deliver local programming to Apple’s Web TV service.

According to industry executives, the television service may not launch until late 2015 or early 2016, as “technology and money issues” continue to be sticking points that have prevented negotiations from being completed. Apple’s desire to provide consumers with local broadcast stations has also reportedly slowed down negotiations as securing all the necessary deals to show local programs and commercials takes a lot of time.

Rumors have suggested that Apple’s streaming television service will feature approximately 25 channels priced at $30 to $40 per month. It would be available over the Internet and would not require a cable subscription package.

While Apple does not plan to debut its streaming television service at the Worldwide Developers Conference next week, it is rumored to be introducing a new Apple TV set-top box with a full App Store that includes apps and games. It’s also expected to introduce a new streaming music service, a revamped version of iTunes Radio, and OS X 10.11 and iOS 9.

Facebook will encrypt the emails it sends to you with PGP

Facebook, the social network where there’s no such thing as too much information is handing another olive branch to the privacy crowd. The company has announced that it’ll allow users to add PGP keys to their profiles, enabling them to encrypt the regular missives that the social network sends out. That way, no-one but you will be able to find out that Dave, the bully from junior high, has tried to add you as a friend twice this month. If you’re wary about the legitimacy of Facebook’s project, take comfort from the fact that one of the testers was noted security expert and former Tor lead, Runa Sandvik.

Latest Android distribution numbers have been posted, Lollipop now on over 12% of all devices

Even though it’s been less than a month since Google last posted its Android distribution numbers, it looks like we’re already seeing new numbers coming in for June 2015. The biggest change we’re seeing this time around is that Android 5.0 and 5.1 Lollipop have now made their way to 12.4 percent of all Android devices, up from the 9.7 percent marketshare we saw last month. Although it’s not a big 4 percent increase like we saw from April to May, Lollipop is still steadily climbing to the top of the charts.

Android 4.4 KitKat is still the most common build available today, currently running on 39.2 percent of all devices. These numbers are only down a mere .6 percent from last month. Jelly Bean hasn’t seen a massive decline either, coming in at 37.4 percent of all devices, a decline of just 1.8 percent from May. Ice Cream Sandwich is installed on 5.1 percent of devices, down .2 percent from last month. Gingerbread still has a higher install rate than ICS with 5.6 percent, just .1 percent down from last month’s numbers. And yes, Android 2.2 Froyo is still installed on .3 percent of all Android devices.

Since last month, we’ve seen a handful of devices receive the update to Android 5.0 Lollipop including the Motorola Moto G (1st Gen.), the Verizon HTC One M7, the Sprint Galaxy S4, and the AT&T Samsung Galaxy Tab S 10.5. Are you still stuck on an older version of Android? The Dark Web may be smaller, pervier than previously thought

Last week, two hackers unleashed an automated scanning tool on the the internet’s deepest layers, known as the Dark Web. This digital underworld is accessible only through the Tor Network and trafficked largely by hackers and criminals looking to avoid the gaze of law enforcement. Hackers Alejandro Caceres and Amanda Towler set their website vulnerability scanning tool, PunkSPIDER, loose on the Dark Web in an effort to improve the semi-anonymizing network’s security but made a surprising discovery: the Dark Web may not be nearly as large as experts estimate.

When PunkSPIDER made its rounds last week, the security tool only found about 7,100 .onion sites in total. Heck it’s entire scan wrapped up in just three hours. “You might notice that’s not a lot of sites. If there’s one thing we’ve learned from Memex it’s that the number of Hidden Services [Tor network sites] up at any time has been greatly overestimated,” Caceres explained to Forbes. Out of that number, only about 2,100 responded within a reasonable time. The pair found that, for the most part, these sites are pretty secure. Just 50 had actionable vulnerabilities, though that’s likely due to their largely single-page, static HTML designs.

Of course, being the Dark Web, the pair did find a number of sites offering illegal content including, “a weird subset of child porn,” Caceres said. “After looking through them there is at least one that we’d like to share with law enforcement before releasing it publicly. This is the one case where we actually don’t want the website administrator to fix their site before someone in law enforcement hacks it – trust me, it’s a really bad one.”
